These Terms of Service (“Terms”) govern your use of getafractional.com (the “Site”) and the diagnostic tools, reports, and related features on it (together, the “Services”). The Services are operated by CBEG Group, LLC, the operator of GetAFractional (“GetAFractional,” “we,” “us,” or “our”).
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
The Services are informational
GetAFractional’s tools give you informational, educational diagnostic output about your business’s finances and bookkeeping. They are not a substitute for professional advice, and using them does not create an accountant-, advisor-, or other professional-client relationship between you and us. Results are generated through automated analysis and may not fit every situation, so check anything important with a qualified professional — such as an accountant, bookkeeper, or attorney — before relying on it. We do not guarantee specific outcomes.
Who may use the Services
You may use the Services only if you can form a legally binding contract with us, and only for your own business or one you are authorized to act for. The Services are intended for business owners, not for personal or consumer use, and are not directed to anyone under 18.
Your responsibilities
You agree to provide accurate information, to upload or submit only information you have the right to share, and to use the Services lawfully. You are responsible for what you submit and for keeping your own copies of anything important to you. If something you submit or do with the Services leads to a claim against us, you agree to cover the resulting reasonable costs.
Payments and refunds
Some reports are paid products, with prices shown at purchase. Payments are processed by our third-party payment processor, and by purchasing you also agree to its terms.
Because paid reports are digital products delivered promptly after purchase, sales are generally final. If a report was not delivered, or has a material defect, contact us at [email protected] within 7 days of purchase and we will work with you to make it right, which may include re-delivery or a refund.
Acceptable use
Do not use the Services unlawfully; do not copy, scrape, or resell the Site or our content except as permitted; do not try to disrupt the Services or gain unauthorized access; and do not upload malicious or deceptive content. We may suspend or end access for conduct that breaks these Terms or that we reasonably believe is harmful.
Your content
You keep ownership of the information and files you submit (“Your Content”). You grant us a limited, non-exclusive license to use, process, store, and transmit Your Content to operate the Services and produce your results — including transmitting it to the service providers described in our Privacy Policy. You confirm you have the rights needed to submit it. This license ends when we delete Your Content in the ordinary course.
Our intellectual property
The Site, the tools, our software, methodology, text, and design (other than Your Content) belong to us or our licensors. We grant you a limited, personal, non-transferable right to use the Services as intended. A report we generate is for use in your own business; you may not resell it or present it as an independent professional opinion.
Disclaimers and liability
The Services are provided “as is,” without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or that any result will be accurate or suitable for your purpose.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to the Services will not exceed the greater of what you paid us in the twelve months before the claim or US$100. Some jurisdictions do not allow certain limitations, so parts of this may not apply to you.
Third-party services
The Services rely on third-party providers and may link to third-party sites. We do not control them and are not responsible for their content or practices.
Changes
We may modify or discontinue the Services at any time, and we may update these Terms; when we do, we will revise the “Effective date” above. Continued use after an update means you accept the revised Terms.
General
These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services. If any provision is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
